The rental deposit: what changed in 2025, and how to get it back

Since 4 September 2025 there is a cap. For landlords with three or more rental units, deposit plus advance rent cannot exceed three months' rent in total, and a clause demanding more is void. Most listings and most tenants have not caught up with this.

What the rule actually says

The Office of the Consumer Protection Board notification that took effect on 4 September 2025 does three useful things. It caps the total upfront payment at three months' rent combining deposit and advance rent. It sets return deadlines: seven days if there is no damage, fourteen if there are deductions. And it requires deductions to be itemised rather than asserted.

The threshold also moved. The regulations now reach owners with three or more rental units, down from five. A private owner with one or two condos is outside the rules, which matters, because a large share of Bangkok condo rentals are exactly that.

Ask this before you sign

"How many units do you rent out?" It sounds like small talk. It tells you whether the deposit cap and the seven-day return deadline apply to your lease at all. An owner with one unit is not breaking any rule by asking for more or taking longer; you just want to know which situation you are in before you hand over money.

The standard ask, and when it is too much

Two months' deposit plus one month advance rent is the Bangkok norm and sits exactly at the cap. If you are asked for two months advance plus two months deposit by a landlord running several units, that is four months and the excess is unenforceable.

Raising this politely, once, at the right moment is usually enough. "I understand the 2025 OCPB rules cap the total at three months, can we do two plus one?" A professional landlord knows this. One who does not is telling you something about how the rest of the lease will be administered.

Getting it back

Deposit disputes are the single most common complaint from departing foreign tenants, and almost all of them are won or lost at move-in rather than move-out.

The move-in hour that saves you two months' rent

  1. Photograph everything, timestamped, before you unpack. Every wall, the floor by the balcony door, the inside of the fridge, the condition of the aircon filters, the grout in the bathroom. Every mark that already exists.
  2. Send the whole set to the landlord the same day, on a channel that keeps a record. Not "here are a few problems". Just "here is the condition at handover for both our records". That message is the evidence.
  3. Get a written condition report if they will do one. Pre-existing damage recorded at move-in cannot be deducted later.
  4. Read the meter and photograph that too. Utilities are a common source of a surprise final bill.

Do that hour of work and a disputed deduction becomes a short conversation instead of a long one. Skip it and you are arguing from memory against someone holding your money.

If it is withheld anyway

Deductions have to be itemised, with receipts or quotes, not a round number in a message. Late return accrues interest at 15% a year from the due date where the regulations apply. Consumer Case Court claims are designed to be brought without a lawyer, and you can bring one after you have left the country by giving someone power of attorney. Most landlords settle long before that, which is precisely why the timestamped photos are worth an hour.
